What is the Emergency Family and Medical Leave Expansion Act?

This legislation amends the federal Family and Medical Leave Act (“FMLA”) to provide a new type of covered public health emergency leave for eligible employees of employers with fewer than 500 employees but more than 50 employees.

Beginning on April 2, 2020 through December 31, 2020, eligible employees will be able to take up to 12 weeks of FMLA leave related to COVID-19 circumstances. To be eligible, a covered employee must be employed by the employer for at least 30 calendar days.
